BetterYou Terms of Service

- Agreement to These Terms
These Terms of Service (these “Terms”) are a binding agreement between you and BetterTime Co., a Delaware corporation (“BetterTime,” “we,” “us,” or “our”). They govern your access to and use of:
- the BetterYou mobile application for iOS and Android (the “App”);
- our website at www.betteryou.ai (the “Website”); and
- all related features, content, and services we offer, including subscriptions, the Bolts rewards program, challenges and contests, and our AI-powered coaching features (collectively with the App and the Website, the “Service”).
By creating an account, accessing, or using any part of the Service, you agree to these Terms and to our Privacy Policy, available at www.betteryou.ai/privacy-policy, which describes how we collect and use your information. If you do not agree, do not use the Service.
If you use the Service through a program offered by your employer or another sponsoring organization, additional terms in our agreement with that organization may also apply to your participation in that program.
- Eligibility
The Service is intended for adults only. To create an account or use the Service you must be at least 18 years of age. By using the Service, you represent and warrant that you meet these requirements. We do not knowingly permit anyone under 18 to create an account, and we may use age signals provided by the Apple App Store or Google Play to enforce this restriction. You agree not to open or attempt to open an account for any person who does not meet these criteria.
- Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us promptly at privacy@betteryou.ai if you believe your account has been accessed without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.
- Subscriptions, Billing, and Free Trials
4.1 Free and paid tiers. Portions of the Service are available free of charge. Other features — including redemption of Bolts for rewards, AI coaching features, and certain premium content — require a paid subscription (“Subscription”).
4.2 Purchases through the app stores. Subscriptions purchased in the App are processed by Apple (through the App Store) or Google (through Google Play), and in some cases by our web payment processor. Prices, subscription periods, and any free-trial terms are displayed at the point of purchase. BetterTime does not receive or store your full payment card details for purchases made through the app stores.
4.3 Auto-renewal. Subscriptions renew automatically at the end of each subscription period, at the then-current price, unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your Subscription at any time in your App Store or Google Play account settings (or, for web purchases, through the billing portal we provide). Deleting the App does not cancel your Subscription.
4.4 Free trials. New users may be offered a free trial with full access to paid features. When a trial ends without conversion to a paid Subscription, your account reverts to the free tier and paid features (including reward redemption) are locked until you subscribe. If your trial was offered through an app store, the store’s trial and billing rules apply.
4.5 Refunds. Purchases made through the App Store or Google Play are subject to the refund policies of Apple or Google, respectively, and refund requests for those purchases must be directed to the applicable store. Except where required by law, all fees are non-refundable.
4.6 Price changes. We may change Subscription prices. Price changes apply to renewals occurring after the change, following any notice the applicable app store or applicable law requires.
- Bolts Rewards Program
5.1 What Bolts are. “Bolts” are virtual points that can be earned through activity in the Service, such as completing goals, participating in trials and challenges, and claiming in-app reward boxes. Bolts are a promotional incentive. Bolts are not money, are not your property, have no cash value, and are not redeemable for cash. Bolts cannot be sold, transferred, exchanged outside the Service, or inherited.
5.2 Earning and caps. Bolt-earning rates, sources, and limits — including annual caps on automatically earned Bolts — are set by BetterTime and displayed in the App. We may adjust earning rates, caps, and eligible activities at any time.
5.3 Redemption. Redeeming Bolts for rewards (such as digital gift cards) requires an active, paid Subscription or participation in an eligible sponsored organization program. Only Bolts earned during a paid subscription period (excluding free-trial periods) are eligible for redemption; Bolts earned on the free tier may be used only for cosmetic and in-app purposes and do not become redeemable upon upgrade. Redemption minimums, conversion rates, and available reward options are shown in the App and may change at any time.
5.4 Reward fulfillment. Gift cards and similar rewards are fulfilled by third-party providers (currently Tango Card, Inc.). Rewards are subject to the terms and conditions of the reward issuer, and BetterTime is not responsible for lost or stolen reward codes after delivery, or for the acts or omissions of merchants whose gift cards are offered. Rewards may be subject to availability and may be substituted with items of comparable value.
5.5 Program integrity and forfeiture. We use automated and manual review to protect the integrity of the rewards program. We may withhold, adjust, or reverse Bolts, deny redemptions, and suspend or terminate rewards access — including forfeiture of accumulated Bolts — where we reasonably believe activity data has been falsified, manipulated, or generated in violation of these Terms (see Section 8). Redemption decisions that have been through our review process are final.
5.6 Program changes. The rewards program is offered at our discretion. We may modify, suspend, or discontinue the program, in whole or in part, at any time. Where reasonably practicable we will provide advance notice of material changes that adversely affect redeemable balances.
- Challenges, Trials, and Contests
6.1 Overview. The Service includes competitive features, including peer-to-peer trials, group challenges, and challenges sponsored by employers or other organizations, some of which offer prizes such as Bolts or gift-card rewards.
6.2 Sponsored prize pools. Prizes for organization-sponsored challenges are funded by the sponsoring organization. Eligibility to participate in a sponsored challenge may be limited to members of that organization’s program.
6.3 Rules and winner determination. Each challenge may have its own posted rules, which are incorporated into these Terms for that challenge. Scoring, ranking, anti-cheat adjustments, and winner determinations are made by BetterTime (or the sponsoring organization, where its rules say so) and, after any applicable review or appeal process, are final. Winners are responsible for any taxes on prizes. Challenges are void where prohibited by law.
6.4 App store disclaimer. Apple Inc. is not a sponsor of, and is not involved in, any contest, challenge, or sweepstakes offered through the Service. Google LLC is likewise not a sponsor of, and is not involved in, any such contest or challenge.
- Health and Wellness Disclaimer
The Service provides general wellness, fitness, sleep, and screen-time information and motivation. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. Content provided through the Service — including scores, insights, coaching messages, sleep estimates, and AI-generated suggestions — is for informational and motivational purposes only and is not a substitute for professional medical advice. Always consult a physician or other qualified health provider before beginning any exercise, sleep, or wellness program, and before making decisions that may affect your health. Never disregard professional medical advice or delay seeking it because of something you encountered in the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.
- Data Integrity and Fair Play
The value of the Service — including its competitions and its rewards economy — depends on honest activity data. You agree not to:
- falsify, inflate, or manipulate activity data (for example, by entering fictitious manual workouts, simulating steps, spoofing device sensors or location, or exploiting multi-device or family-sharing configurations);
- use bots, scripts, emulators, or modified clients to interact with the Service;
- share, sell, or transfer accounts, or operate multiple accounts to gain an advantage; or
- otherwise abuse challenges, trials, or the rewards program.
We may apply automated integrity measures — including capping anomalous activity data, excluding suspect data from scoring, and flagging accounts for review — and may suspend or terminate accounts and forfeit Bolts or prizes for violations. If you believe an integrity action was taken in error, you may appeal through the in-app process, and we will review it.
- License and Acceptable Use
9.1 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, and to access and use the Service, in each case for your personal, non-commercial use.
9.2 Restrictions. You may not (except as permitted by law): copy, modify, or create derivative works of the Service; reverse engineer, decompile, or attempt to extract source code; rent, lease, sell, or sublicense the Service; remove proprietary notices; access the Service to build a competing product; scrape or harvest data from the Service; interfere with or disrupt the Service or its security features; or use the Service for any unlawful purpose or in violation of any applicable law.
9.3 Community conduct. Where the Service includes social features (activity feeds, reactions, buddy and group features), you agree not to post content that is unlawful, harassing, hateful, obscene, deceptive, or infringing, and not to use social features to harass or harm other users. We may remove content and restrict social features at our discretion.
- Your Content
10.1 Ownership. You retain ownership of the content you submit to the Service, including journal entries, messages, photos, and other materials (“User Content”).
10.2 License to us. You grant BetterTime a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and transmit your User Content solely as needed to operate, provide, improve, and secure the Service and as otherwise described in our Privacy Policy. This license ends when your User Content is deleted from our systems, except where retention is required by law.
10.3 Responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to grant the license above.
10.4 Feedback. If you send us suggestions or feedback about the Service, we may use them without restriction or obligation to you.
- Intellectual Property; Copyright Complaints
The Service and all of its content (other than User Content) — including software, text, graphics, logos, the BetterYou and BetterTime names and marks, and the BetterBot character — are owned by BetterTime or its licensors and are protected by United States and international intellectual-property laws. No rights are granted to you other than the limited license in Section 9.
If you believe your copyrighted work has been used in the Service in a way that constitutes infringement, send a notice to our copyright agent at privacy@betteryou.ai (subject line “Copyright Issues”) or by mail to BetterTime Co., Attn: General Counsel, 370 N Wabasha St, Saint Paul, MN 55102, including: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the material claimed to be infringing and its location within the Service; (iv) your address, telephone number, and email address; (v) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Third-Party Services
The Service connects with third-party platforms and services, including Apple Health, Google Health Connect and Google Fit, wearable devices, app-store billing, and third-party reward fulfillment. Your use of any third-party service is governed by that third party’s own terms and privacy policy, and BetterTime is not responsible for third-party services. The Service may also contain links to third-party websites; we are not responsible for their availability or content.
- Additional Terms for the Apple App Store
If you downloaded the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and BetterTime only, not with Apple. Apple is not responsible for the App or its content.
- Your license to the App is limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service (except that the App may be accessed by other accounts via Family Sharing or volume purchasing, where available).
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws.
- In the event of a third-party claim that the App or your possession and use of it infringes intellectual-property rights, BetterTime, not Apple, is responsible for the investigation, defense, settlement, and discharge of the claim, to the extent required by these Terms.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license to the App and may enforce them against you.
- Term and Termination
These Terms apply from your first use of the Service. You may stop using the Service and delete your account at any time (in-app or by contacting privacy@betteryou.ai). We may suspend or terminate your access to all or part of the Service at any time if you breach these Terms, if we reasonably believe your use poses a risk to the Service or other users, or if we discontinue the Service. Upon termination, your license to use the Service ends and unredeemed Bolts are forfeited (Bolts have no cash value; see Section 5). Sections that by their nature should survive termination — including Sections 5.1, 7, 8, 10, 11, and 15 through 18 — survive.
- Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETTERTIME DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ACTIVITY DATA, SCORES, SLEEP ESTIMATES, OR AI-GENERATED CONTENT WILL BE ACCURATE OR RELIABLE; OR THAT DEFECTS WILL BE CORRECTED. AI-POWERED FEATURES MAY PRODUCE INACCURATE OR INCOMPLETE OUTPUT; YOU SHOULD NOT RELY ON THEM AS PROFESSIONAL ADVICE OF ANY KIND.
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BETTERTIME OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM OR RELATING TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, BETTERTIME’S AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO BETTERTIME FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
- Indemnification
You agree to indemnify, defend, and hold harmless BetterTime and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your violation of these Terms, or your violation of any law or the rights of a third party.
- Governing Law; Disputes
These Terms and your use of the Service are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. The state and federal courts sitting in Minneapolis, Minnesota will have exclusive jurisdiction and venue over any dispute arising out of these Terms or the Service, and you consent to the jurisdiction of those courts. Reasonable attorneys’ fees and costs will be awarded to the prevailing party in any litigation involving the enforcement or interpretation of these Terms.
- Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last Updated” date above and post the revised Terms on the Website and in the App. For material changes, we will provide additional notice as required by law or app-store policy (for example, in-app notice or email). Your continued use of the Service after revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, stop using the Service.
- General
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any posted challenge rules or supplemental terms, are the entire agreement between you and BetterTime regarding the Service. Section headings are for convenience only.
